TERMS AND CONDITIONS OF SALE

1. Seller identity

These General Terms and Conditions of Sale (hereinafter the "GTC") govern the sale of products on the OXYNOME website.

Hereinafter referred to as "OXYNOME" or "the Seller".

These GTC apply to any order placed by a consumer on the OXYNOME website.

2. Purpose and acceptance of the GTC

These GTC define the rights and obligations of OXYNOME and its Customers in connection with the online sale of products offered on the site.

Any order implies full and complete acceptance of these GTC.

Before definitively validating their order, the Customer is invited to read these GTC and accept them.

The applicable GTC are those in force on the date of the order.

3. Products

OXYNOME notably markets cosmetic products for face, hair and scalp care.

The essential characteristics of each product are presented on its product sheet: description, capacity, usage tips, precautions for use, and list of ingredients where applicable.

Product photographs and representations are provided for illustrative purposes. Slight differences in presentation, particularly concerning colors, packaging or conditioning, may exist without affecting the essential characteristics of the product.

The Customer is invited to read the information on each product sheet before placing an order.

4. Product availability

Products are offered for sale within the limits of available stock.

In the event of unavailability of a product after order validation, OXYNOME will inform the Customer as soon as possible.

The Customer may then, depending on the circumstances, receive a refund for the unavailable product or cancellation of the order concerned.

5. Price

Product prices are indicated in euros (€), all taxes included (TTC).

Delivery costs are indicated to the Customer before final validation and payment of the order.

OXYNOME reserves the right to modify its prices at any time. Products are, however, invoiced based on the prices displayed at the time of order validation by the Customer.

For deliveries outside mainland France, taxes, customs duties or other charges may be applicable depending on the country of destination. When they are not collected directly during the order, they remain the responsibility of the Customer.

6. Order

The Customer selects the products they wish to purchase and adds them to their cart.

Before proceeding to payment, they can check the details of their order, its total price, any delivery costs, and correct the information entered.

The order becomes final after validation of the cart, entering the necessary information for the order and delivery, acceptance of these GTC, and payment validation.

An order confirmation is then sent to the Customer at the email address provided during the order.

OXYNOME reserves the right to refuse or cancel an order in the event of fraud, attempted fraud, payment incident, or prior dispute relating to the payment of an order.

7. Pre-orders and presales

Some products may be offered for pre-order or presale before their actual availability.

This information, as well as the estimated shipping period or date when known, is specified on the product sheet concerned.

The deadlines announced for pre-ordered products may be subject to change, particularly due to production or supply constraints.

In the event of a significant change in the estimated availability date, the Customer will be informed.

Products purchased on pre-order benefit from the same legal guarantees as other products.

8. Payment

Payment is due at the time of order.

The available payment methods are indicated to the Customer during the ordering process on the website.

Transactions are carried out through the payment service providers offered on the Shopify store.

OXYNOME does not retain the Customer's complete banking data.

The order may be suspended or cancelled in the event of payment refusal by the banking institution or the payment service provider.

9. Delivery

Products are delivered to the address indicated by the Customer when placing their order.

Available delivery methods, their rates, and corresponding estimated delivery times are presented to the Customer at the time of order.

Depending on the destination and the options available on the site, several delivery methods may be offered, including home delivery, express delivery, or pick-up point delivery.

The Customer is responsible for the accuracy and completeness of the information provided for delivery.

OXYNOME cannot be held responsible for any delay or impossibility of delivery resulting from an incorrect or incomplete address provided by the Customer.

Where no specific deadline is indicated, the order is delivered within the period provided by the applicable legal provisions.

In the event of delayed delivery, the Customer benefits from the rights provided by the Consumer Code.

10. Receipt of the order

Upon receipt of their order, the Customer is invited to check the condition of the package and the products.

In case of damaged, missing, or clearly non-conforming product, the Customer is invited to contact OXYNOME as soon as possible to facilitate the processing of their request.

This step does not deprive the Customer of the benefit of their legal guarantees.

It is recommended to keep elements that can establish the problem encountered, particularly photographs of the package and the product concerned.

11. Right of withdrawal

In accordance with the provisions of the Consumer Code, the consumer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to justify their decision.

To exercise their right of withdrawal, the Customer must inform OXYNOME of their decision by means of an unambiguous declaration or the standard withdrawal form at the end of these GTC.

12. Return of products

After having communicated their decision to withdraw, the Customer has 14 days to return the products concerned.

Unless otherwise indicated or offered for coverage by OXYNOME, the direct costs of return remain the responsibility of the Customer.

The product must be returned in a condition allowing it to be put back on sale, subject to the manipulations necessary to establish its nature and characteristics.

The applicable return address is communicated to the Customer when their request is processed if it differs from the registered office address.

13. Exception to the right of withdrawal – Cosmetic products

In accordance with the Consumer Code, the right of withdrawal cannot notably be exercised for goods that have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.

This exception may notably concern certain cosmetic products unsealed after their delivery when their nature makes it impossible to put them back on sale for reasons of hygiene or health protection.

This exception does not limit the Customer's rights when a product is defective or non-compliant.

14. Refund

When the right of withdrawal is validly exercised, OXYNOME refunds the amounts due to the Customer in accordance with the applicable legal provisions.

The refund includes the price of the products concerned as well as, where required by law, the standard delivery costs initially invoiced.

Any additional costs resulting from the Customer's choice of a more expensive delivery method than the proposed standard method are not refunded beyond the cost of standard delivery.

The refund is made using the same payment method as that used for the initial transaction, unless the Customer expressly agrees to another method and provided that this does not incur additional costs.

OXYNOME may defer reimbursement until the goods have been recovered or until the Customer provides proof of their shipment, in accordance with applicable legal provisions.

15. Legal guarantees

The products marketed by OXYNOME benefit from the applicable legal guarantees, notably the legal guarantee of conformity and the guarantee relating to hidden defects of the item sold.

The Customer benefits from these guarantees under the conditions and for the durations provided by French law.

The legal guarantee of conformity notably allows the consumer to obtain the conformity of the good under the conditions provided by the Consumer Code.

The Customer may also invoke the guarantee against hidden defects provided for by articles 1641 et seq. of the Civil Code when the conditions of this guarantee are met.

These guarantees apply independently of any commercial guarantee.

16. Use of products

The Customer must comply with the advice for use, precautions, and warnings appearing on the product, its packaging, or its product sheet.

In the presence of a known sensitivity to any of the ingredients, the Customer is invited to consult the list of ingredients before use.

OXYNOME cannot be held responsible for damage resulting from use of the product not conforming to its intended purpose, the instructions provided, or the precautions for use.

17. Liability

OXYNOME is responsible for the proper performance of the obligations arising from the contract under the conditions provided by applicable law.

However, its liability cannot be invoked when the non-performance or improper performance of the contract is attributable to the Customer, to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.

No provision of these GTC can have the effect of deleting or limiting the mandatory rights enjoyed by the consumer.

18. Personal data

Personal data collected in connection with orders is used for their management, payment, delivery, customer service, as well as to meet applicable legal and regulatory obligations.

Certain information may be transmitted to the service providers necessary for the execution of the order, notably payment and delivery service providers, and the technical solutions used by the site.

The processing of personal data is also detailed in the Privacy Policy accessible on the OXYNOME website.

19. Complaints

The Customer is invited to specify their order number and the information allowing their request to be processed.

20. Consumer mediation

In the event of a dispute, the consumer Customer is invited to first contact OXYNOME to seek an amicable solution.

Failing an amicable agreement, the consumer may have free recourse to the consumer mediator under the responsibility of ATH & CO:

21. Applicable law and dispute resolution

These GTC are subject to French law.

In case of difficulty, the Customer is invited to contact OXYNOME to seek an amicable solution.

The consumer also has the possibility of resorting to the mediation mechanism indicated in these GTC.

Failing an amicable resolution, the dispute may be brought before the competent courts in accordance with the applicable legal rules.
